1. Definitions
Henceforth, Voyley AB is referred to as “we” or “us”; the physical or legal person that is using any of the services that we provide is referred to as “you” or “user”; any third party that produce and/or perform the services that we provide is referred to as “producer”. All documents, digital or physical, that entitle you to one or more services are referred to as “products”; the fulfillment of products, digital or physical, from us or a relevant producer is referred to as “distribution”.
2. About these terms
These terms and conditions are valid as of 2020-09-25 and constitutes a legally binding agreement between you and us. When any of our services, including our websites and mobile applications are used or consumed by you, you agree to these terms in full.
3. Search engine
Based on your search input, we provide you with a clear overview of various travel options using different methods of transport (i.e. train or bus). As we rely on the information made available by third parties, booking platforms and information platforms, we cannot guarantee the accuracy or completeness of the results. You can proceed to compare the travel options by price and travel duration from other travel aggregators.
4. Bookings
Bookings are considered started when we receive the booking order, and completed after they have been distributed by us. For orders that require manual handling, including but not limited to products that are distributed via post, an additional handling time of 10-15 work days is required. In connection with your order, regardless of product and channel, you will receive an order confirmation after payment has been made. After the booking has been completed, the responsibility for any errors in the order is transferred from us to you. You are therefore required to carefully review the booking summary prior to placing the order, and notify us about any inaccuracies in the order as soon as possible, should they arise. Once the summary has been reviewed and accepted, the booking is binding.
5. Payment
In cooperation with Stripe, Inc, we offer you payment options via credit/debit card which are made directly to Stripe. More information about Stripe’s user terms can be found here. For general information on Stripe, you can find it here. Your personal data and payment information is respectively handled in accordance with our privacy policy and in accordance with the Stripe’s privacy notice which can be found here. The price of many of our products are dynamic and may change over time. As such, you are therefore only guaranteed the prices offered at the time you complete your order. The final price shown to you before payment is made is always inclusive of booking fees and taxes when applicable.
6. Distribution
Means of distribution and delivery time varies depending on the respective product, channel and market. Digital products are distributed immediately after booking is successfully completed, or the day before departure date, depending on the terms of service stipulated by the corresponding producer. When digital products are distributed, they are considered successfully delivered to you, unless you notify us in a timely manner so that we have a possibility to attempt another delivery.

Physical products are shipped after successfully completed booking. Once the physical products have been delivered to you or to a drop-off point for you to collect them, they are considered successfully delivered.

Please note that products are documents of value, and as such they must be collected by the buyer in person, and you must be able to present legally valid photo ID. Shipping fees are charged in accordance with our price list at the time of order. If you neglect to collect, receive, or otherwise obstruct or prevent successful delivery, a return fee will be charged for each parcel. If we need to attempt a second delivery, you will be charged an additional shipping fee. If the products can’t be re-delivered, we will automatically cancel them and perform a full/partial refund as stipulated in the terms of service for corresponding producer.
7. Registration
You can create an account with us. You can access your individual profile by entering your email and selected password or via a Facebook/Google login. Your personal data and booking information will be handled in accordance with our privacy policy.

Only legal adults and natural persons of full legal capacity may become registered users. The user must provide all required information in a complete and correct manner and, when necessary, provide updates. Registration is non-transferable.

Once registered, your account will be active for an indefinite period of time. Both the user and us are entitled to terminate the account at any time by providing two days' notice. The right to termination without notice for good cause remains unaffected.
8. Limitations
We make our website and its respective functions available to users; there is no entitlement to the provision of specific functions. We have the right to make changes to the content or functionality at any time (for example: through patches, updates or modifications). We do not guarantee the permanent availability of our website. More specifically, technical problems that are outside of our control may lead to downtime. Website maintenance may affect availability and will be carried out, when possible, with due care to prevent disruption. Proprietary rights and all other rights relating to this website belong to us.
9. Producer’s terms and conditions
Our products are covered, when applicable, by the terms and conditions of the relevant producer(s). As such, it is your responsibility to read, and accept the terms and conditions of the relevant producer(s) prior to ordering any services that the relevant Producer offers via our services.
10. Documents of value
Physical products are documents of value, and you are responsible to store and handle them as such. If any products are lost, stolen, destroyed, altered or otherwise rendered invalid you will not be refunded or compensated.
11. Right of withdrawal
Right of withdrawal is not applicable for products that are specified to a time or a place. For any and all other products you are entitled to right of withdrawal for 14 days, which is counted from the day that the product has been successfully delivered. To claim your right of withdrawal, you need to notify us within the aforementioned 14 days. In the event that the products have been partially or fully used, or otherwise reduced in value, we will adjust the refundable amount accordingly. Should you wish to cancel the transport or travel service and withdraw from the contract, the applicable terms and conditions and costs for cancellation will be based on the conditions set out by the relevant third-party provider.We will handle your cancellation request and forward it to the relevant carrier. You can contact us by telephone or via email. In some instances, it may be possible to cancel directly with the carrier if the ticket's conditions allow for this.
12. Traveler’s documentation
You are solely responsible to gather information about, and to produce, any and all documents that are required to conduct your travel. This includes valid photo identification, passport, visa and/or similar documents.
13. Rebooking, cancellation and repurchase
Rebooking, cancellation and repurchase is conducted in accordance with the producer’s terms and conditions. Any travel must be cancelled no later than the day before departure and all physical products, when applicable, must be returned to us within a month from that date. You are responsible for any costs associated with returning the products and responsible for them until they have been successfully returned to us. In the event of rebooking, cancellation or repurchase, booking fees are not refunded. Shipping fees are only refunded if right of withdrawal applies. Refunds are completed as fast as possible.
14. Claims
We are unable in any way to affect, and are therefore not responsible for, delays, cancelled transportation, or other lapses in quality that may affect your travel. You can however always file a claim with the relevant producer if your travel has suffered from any of the above. You need to be able to produce supporting documents, including but not limited to receipts for any unexpected costs. If we are to assist you with your claim, we must receive your supporting documents together with the relevant tickets within one month from departure date.
15. Limitation of liability (Producers)
We endeavor to ensure that the information presented on our website is accurate. When providing details on travel services and connections, we rely on the information conveyed to us by the relevant third-party providers. We are unable to fully verify the accuracy or currency of the information that we gather and display. Our reviews are carried out on an ad-hoc basis. We therefore ask that you please review the individual travel details yourself. We make no representations or warranties, nor can we offer our users any guarantee as to the accuracy, completeness or currency of the travel information. The same applies to all other information presented on our website that is or has been made available to us by third-party providers. We do not participate in the presentation or description of travel services on the websites of third-party providers. We are therefore not liable for the content of third-party offers or for any contracts concluded with third-party providers.

When acting as an intermediary for third-party offers, we bear no responsibility for the availability of services or travel connections at the time of booking (on third-party provider websites) or for the actual delivery and satisfactory performance of services booked with third-party providers. Neither we nor our affiliates make any representations or warranties with respect to the information, products, services or software provided on or contained within our website, in particular with regard to the suitability for a specific purpose – unless this has been expressly and individually agreed to with our users. Any warranty claims or claims for damages are to be brought directly against the relevant third-party provider.

We are not liable for any disturbance or interference in the network which has not been caused by us. We strive to ensure the faultless and uninterrupted technical operation of our service. We cannot, however, assume any responsibility or liability for the uninterrupted and prompt accessibility or availability of our service. This applies in particular to technical delays and failures and any damages resulting therefrom.

Our website contains links to other sites that we do not operate or control and for which are not responsible. We do not endorse the content of these websites nor do we take any responsibility for the lawfulness or functionality of such content and are furthermore not liable for any loss or damage that may be caused by the use of such sites. We recommend that you carefully read the Terms of Use for each of these websites.

Our own liability in accordance with the section below remains unaffected.
16. Limitation of liability
Our liability and that of our employees, legal representatives or agents shall be limited to willful intent and gross negligence. This limitation does not apply to injuries to life, limb or health, to breaches of warranty, to claims under the Swedish Product Liability Act (Produktansvarslag) or to material breach of contract, i.e. obligations which are essential to the proper performance of the contract or fulfilment of the contract purpose, or on the observance of which the contractual partner may regularly rely.

In the case of breach of material contractual obligations through minor or simple negligence we are only liable for typical and foreseeable damages.
17. Fraud policy
We reserve the right to unilaterally and without advance information cancel your bookings in the event that we have strong reason to believe that the booking is fraudulent. Any and all frauds, successful or attempted, will be reported to the police and any and you will be charged all costs that the fraud incurs.
18. Data protection
Our privacy policy outlines the way in which we handle your data when you use our service. By using our website and/or our mobile apps, you consent to the use of your information in accordance with our privacy policy
19. Changes to our terms and conditions of use
Our services are constantly evolving and expanding. We therefore reserve the right to modify these terms and conditions at any time. For existing users, the terms and conditions that were valid at the time of the last booking will apply, unless a notice of amendment was received beforehand.
20. Dispute resolution (online)
In the event of a dispute, we do an individual assessment from case to case. We do not commit to follow decisions from Allmänna Reklamationsnämnden (ARN). You are entitled to request alternative dispute resolution through the European Unions ODR-platform on the website: http://ec.europa.eu/odr. Both parties must bilaterally agree to use ODR in order to solve the dispute through the ODR-platform.

In accordance with Section 36 of the German Act on Alternative Dispute Resolution in Consumer Matters (VSBG), we hereby inform you that we are neither willing nor obliged to participate in a dispute resolution procedure before a consumer arbitration board.
21. Statutory and required information
Our website uses cookies. Cookies are text files that are stored on your computer to enable us to deliver and improve the services on our website. Whenever you use one of our websites you consent to our use of cookies. If you do not consent to us storing cookies on your computer, you may disable cookies in your browser, but in that event, we can’t guarantee that we can provide all functionality in our online services.

The contractual relationship between us and the user will be governed by Swedish law, unless a different jurisdiction is applicable as per law. The exclusive place of jurisdiction is Sweden, provided the user is a merchant or a legal person under public law. We are headquartered in Stockholm, Sweden. Stockholm will also serve as the place of jurisdiction if the user has no general place of jurisdiction within Sweden. Any additional mandatory places of jurisdiction for users classified as consumers, at their respective home or place of residence remain unaffected.
